This chapter focuses on the dispute between necessitarians and contingentists, mainly addressing the issue as to whether laws of nature are metaphysically necessary or metaphysically contingent with a weaker kind of necessity, commonly referred to as natural, nomological, or nomic necessity. It is assumed here that all fundamental properties are dispositional or role properties, making the dispute a strictly verbal one. The existence of categorical intrinsic properties as well as dispositional properties is also assumed and the relationship between them examined. (...) Finally, the chapter concludes by returning to the debate between necessitarians and contingentists under the assumption that both dispositional and categorical fundamental properties exist. It is argued here that necessitarian positions can be recast as contingentist, but that there are unequivocally contingentist positions preferred because they are less mysterious despite being ontologically more complex. When performing an action of a certain kind, an agent typically has se- veral reasons for doing so. I shall borrow Davidson’s term and call these rationalising reasons (Davidson 1963, 3). These are reasons that allow us to understand what the agent regarded as favourable features of such an action. (There will also be reasons against acting, expressing unfavour- able features of such an action, from the agent’s point of view.) I shall say that R is a rationalising reason of (...) agent X’s for K-ing iff R consists of (i) a desire of X’s to L and (ii) a belief of X’s that K-ing promotes L-ing (to be discussed shortly). It is frequently said that when an agent X is K-ing and has several rationalising reasons for K-ing, not all of those reasons are reasons for which X is K-ing, that motivate X’s K-ing, or that explain X’s K-ing. What values, if any, would be undermined by determinism?[i] Traditionally this question has been tackled by asking whether determinism is compatible with free will or whether it is compatible with moral responsibility. Compatibilists say that determinism would not threaten free will or moral responsibility, and hence that people’s values should not be influenced by whether or not they believe in determinism. Incompatibilists say that determinism would undermine free will or moral responsibility, and hence that a belief in determinism should have (...) a considerable impact on one’s values, precluding many popular evaluative beliefs. The aim of this paper is to offer a classification of particulars in terms of their relations to spatiotemporal and spatial regions. It begins with an examination of spatiotemporal particulars, and then explores the extent to which a parallel account can be offered of continuants, or spatial particulars that can endure and change over time, assuming such particulars exist. For every spatial particular there are spatiotemporal particulars that can be described as its life and parts thereof. But not every time-slice (...) of a spatiotemporal particular yields a spatial region suitable for hosting a corresponding spatial particular. Events are spatiotemporal particulars though not all spatiotemporal particulars are events. Objects and states are spatial particulars though not all spatial particulars are objects or states. Spatial and spatiotemporal particulars can be either bare regions, or the contents or material contents of such regions, or property instantiations. It is left open whether events are contents of regions, property instantiations, or both. But it is argued that objects are material contents of spatial regions while states of objects are property instantiations. Spatiotemporal particulars can be changes or nonchanges. Events and states can be instantaneous while objects cannot. (shrink)

The replication crisis has prompted many to call for statistical reform within the psychological sciences. Here we examine issues within Frequentist statistics that may have led to the replication crisis, and we examine the alternative—Bayesian statistics—that many have suggested as a replacement. The Frequentist approach and the Bayesian approach offer radically different perspectives on evidence and inference with the Frequentist approach prioritising error control and the Bayesian approach offering a formal method for quantifying the relative strength of evidence for hypotheses. We suggest that rather than mere statistical reform, what is needed is a better understanding of the different modes of statistical inference and a better understanding of how statistical inference relates to scientific inference. Recent theory suggests that action prediction relies of a motor emulation mechanism that works by mapping observed actions onto the observer action system so that predictions can be generated using that same predictive mechanisms that underlie action control. This suggests that action prediction may be more accurate when there is a more direct mapping between the stimulus and the observer. We tested this hypothesis by comparing prediction accuracy for two stimulus types. A mannequin stimulus which contained information about the effectors (...) used to produce the action and a point stimulus, which contained identical dynamic information but no effector information. Prediction was more accurate for the mannequin stimulus. However, this effect was dependent on the observer having previous experience performing the observed action. This suggests that experienced and na¨ıve observers might generate predictions in qualitatively difference ways, which may relate to the presence of an internal representation of the action laid down through action performance. This idea is essential to Mormonism, which provides a religious framework consistent with naturalism and supportive of human transformation. Mormon transhumanists are not limited to traditional or popular accounts of religion, and embrace opportunities and risks of technological evolution. Although usually considered secular, transhumanism has some religious origins and sometimes functions as religion. Accelerating change contextualizes a Mormon transhumanist narrative of common expectations, aspirations, and parallels between (...) Mormonism and transhumanism. Questions regarding the formation of the Universe and ‘what was there’ before it came to existence have been of great interest to mankind at all times. Several suggestions have been presented during the ages – mostly assuming a preliminary state prior to creation. Nevertheless, theories that require initial conditions are not considered complete, since they lack an explanation of what created such conditions. We therefore propose the ‘Creatio Ex Nihilo’ (CEN) theory, aimed at describing the origin of the Universe from (...) ‘nothing’ in information terms. The suggested framework does not require amendments to the laws of physics: but rather provides a new scenario to the Universe initiation process, and from that point merges with state-of-the-art cosmological models. The paper is aimed at providing a first step towards a more complete model of the Universe creation – proving that creation Ex Nihilo is feasible. Further adjustments, elaborations, formalisms and experiments are required to formulate and support the theory. (shrink)

Mounting empirical evidence underscores the health benefits of the arts, as recently reported in a scoping review by the World Health Organization. The creative arts in particular are acknowledged to be a public health resource that can be beneficial for well-being and health. Within this broad context, and as a subfield of participatory arts, the term social arts (SA) specifically refers to an art made by socially engaged professionals (e.g., artists, creative arts therapists, social workers, etc.) with non-professionals who determine (...) together the content and the final art product (in theater, visual arts, music, literature, etc.) with the aim to produce meaningful social changes. SA can enhance individual, community, and public health in times of sociopolitical instability and is an active field in Israel. However, SA is still an under-investigated field of study worldwide that is hard to characterize, typify, or evaluate. This paper presents a research protocol designed to examine a tripartite empirically-based model of SA that will cover a wide range of SA training programs, implementations, and impacts. The findings will help refine the definition of SA and inform practitioners, trainers, and researchers, as well as funding bodies and policymakers, on the content and impact of SA projects in Israel and beyond. Atwater v. Lago Vista is a stand-alone case in Fourth Amendment jurisprudence. Often basic Fourth Amendment jurisprudence builds off other case law. There is a clear buildup regarding the exclusionary rule from Weeks v. United States (1914) to Silverthorne Lumber Co. v. United States (1920) to the expansion of “the fruit of the poisonous tree” doctrine to Mapp v. Ohio (1961) incorporating U.S. Constitution the Fourth Amendment to the states. -/- Likewise, there are cases building up from the incorporation into (...) the states from United States v. Leon (1984) to Arizona v. Evans (1995), expanding Fourth Amendment case law and rights. The cavalcade of these cases somewhat plays a ballet of expanding and contracting the rights in certain circumstances. But the rights build off and limit each other in a cognizable method. -/- Atwater v. Lago Vista is not based on such a cavalcade of cases. It is a stand-alone case at best citing 1600s case law, norms, and rules from before the founding of the United States. Granted, the United States adopted much of the English jurisprudence in the founding of the United States. (shrink)

Thomas Hobbes wrote in his Leviathan that money exchanging hands, monetary policies, activities, and transactions are the blood of the “Leviathan” - the eponymous subject of the book. Hobbes writes that this Leviathan's “blood” includes the “collectors, receivers, and treasurers; of the second are the treasurers again, and the officers appointed for payment of several public or private ministers.” Hobbes, follows this with an analogy of a living man, stating that this “artificial man maintains his resemblance with the natural [man]; (...) whose veins, receiving the blood from the several parts of the body, carry it to the heart; where, being made vital, the heart by the arteries sends it out again, to enliven and enable for motion all the members of the same.” Hobbes maintains a parallel between the natural man and what he calls the “artificial man”, the state throughout his Leviathan. -/- Ultimately, the mechanisms of finance in the United States are the accumulation of historical precedents - both legal and non-legal (such as economic, but also social). These precedents have led to the current system, on a continuing and settled basis. The legal and economic systems merging for the best system of an international monetary order can represent a balance of legal realism and legal formalism. -/- “Money” is printed by the U.S. government, designated as an official note. Value is correlated with how many of those printed pieces of paper exist. This is the basic concept of inflation. This concept of value and inflation is said to be connected to a commodity - such as how much gold or silver existed in the Federal Reserve's physical locations or Fort Knox. Such systems have been in place since at least Mesopotamia, where clay tablets were used to represent credit, or comparable contracts that seem to resemble modern forms of fiat currency. (shrink)

This article is divided into three substantive sections. Section I delineates Aristotle’s theory of the soul as laid out in De Anima. Section II defines habeas corpus as a legal concept and demonstrates under what circumstances it should be granted. Section III applies Aristotle’s theory of the soul as a structure whereby animals could be granted habeas corpus rights.

Noa Naaman-Zauderer’s book aims to bring to light the ethical underpinnings of Descartes’ system: on her view, in both the practical and the theoretical spheres Descartes takes our foremost duty to lie in the good use of the will.The marked ethical import of Cartesian epistemology takes the form of a deontological, non-consequentialist view of error: epistemic agents are praised/blamed when they fulfill/flout the duty to not assent to ideas that are less than clear and distinct.Extra-theoretical realms admitting of no clear (...) and distinct perceptions are subject to ‘softer’ duties of acting on the basis of the best available reasons. Since Cartesian epistemology involves ethical considerations,and since the late Cartesian ethics of virtue crucially depends on metaphysical knowledge about the nature and function of the will, Descartes’ ethics is not just a fruit of his tree of knowledge but it also nourishes its own roots. This book is a new scholarly edition of Lincoln Steffensâ classic, â oemuck-rakingâ account of Gilded Age corruption in America. It provides the broader political background, theoretical and historical context needed to better understand the social and political roots of corruption in general terms: the social and moral nature of corruption and reform. Steffens enjoyed the support of a multitude of journalists with first-hand knowledge of their localities. He interviewed and came to know political bosses, crusading district attorneys and (...) indicted corruptionists spanning a cast of hundreds. He also benefited from the support of a large-scale, nationally prominent network of anti-corruption specialists and luminaries, including President Theodore Roosevelt. Steffens explored in detail the high Gilded Age corruption of New York City, Chicago, â oecorrupt and contentedâ Philadelphia, Pittsburgh, St. Louis and Minneapolis. His work culminated in a well-documented record of Gilded Age corruption in the cities; and, with the addition of the editorial annotations, Chronology and Introduction of this edition, the reader is placed in a position to gain an overview and considerable insight into the general, moral and social-political phenomenon of corruption. This paper is about teaching philosophy to high school students through Lincoln-Douglas (LD) debate. LD, also known as “values debate,” includes topics from ethics and political philosophy. Thousands of high school students across the U.S. debate these topics in class, after school, and at weekend tournaments. We argue that LD is a particularly effective tool for teaching philosophy, but also that LD today falls short of its potential. We argue that the problems with LD are not inevitable, and we (...) offer strategic recommendations for improving LD as a tool for teaching philosophy. Ultimately, our aim is to create a dialogue between LD and academic philosophy, with the hope that such dialogue will improve LD’s capacity to teach students how to do philosophy. (shrink)

Abstract: This study explores some theoretical issues in scientific research such as, the nature of experimentation and problems of methodology in scientific practice as well as the question of truth, rationality, objectivity and utility of scientific discoveries. The paper discusses a number of theorizing that have emerged in response to the challenge raised by the above concerns. Epistemological models of science from critical rationalists, like Popper, Kuhn, Feyerabend and the neo-pragmatic methodological orientation of Arthur Fine’s Natural Ontological Attitude (NOA) to (...) Science, have been adopted as points of discussion on what science as an empirical discipline entail. The paper concludes that a rigorous epistemological discussion on the methodology of scientific inquiry is a desideratum for the progress of science. (shrink)

This article investigates the original meaning of dependent arising in the Buddha’s teaching, by focussing on the imasmi" sati formula. Modern scholars such as the Rhys Davidses, K.N. Jayatilleke and Paul Williams have interpreted it as a princi- ple of causation, comparable to a scientific conception of causation. I argue instead that this formula implies that the Buddha held that causation is nothing more than the correlation of causes and effects, and that it commits the Buddha to a Humean regularity (...) thesis about causation. I draw a distinction between the Buddhist and scientific concepts of causation, and then summarise an alternative approach made by more recent scholars such as Sue Hamilton, Noa Ronkin and Eviatar Shulman, who present dependent arising in terms of conditionality in the causal structure of subjective experience. I conclude by presenting the argument that the imasmi" sati formula does not express a principle of causation but is rather a formula for the method of discovering and presenting causation as conditionality in experience. Pourtant, cette hostilité à l’égard de la causalité des objets est relativement récente ; la causalité agentive semble, au moins jusqu’à Thomas Reid (1710-1796), avoir été la norme, et non le mystère. La mise à l’écart des objets et des agents de la catégorie de cause est-elle justifiée ? Un nombre grandissant de philosophes, les agentialistes (agent-causalists), soutiennent que non et cherchent à réhabiliter l’idée de causalité agentive (par des agents) et/ou substantielle (par des substances), tandis que d’autres, les évènementialistes (event-causalists), défendent que celle-ci est au mieux réductible à la causalité entre évènements, ou au pire que l’idée est incohérente. L’importance de cette question n’est pas négligeable, car elle revient à demander quels sont les moteurs du changement. En effet, nous voulons savoir si certains objets tels que les couteaux, les bombes, les animaux et les personnes sont parfois à l’origine du changement, ou si tout effet procède uniquement de changements antérieurs, d’évènements. Existe-t-il une relation causale, la causalité agentive ou substantielle, reliant objets et changements, différente des relations causales habituellement traitées par les philosophes de la causalité ? Existing social disparities in the United States are inconsistent with Lincoln’s promise of democracy; therefore, there is a need for a critical conceptualization of the first principles that undergird American democracy and the genesis of democratic social change in America. This study aimed to construct a grounded theory that provides an understanding of the process of American democratic social change. The result was the construction of two frameworks: the demoralization process that triggers social change, and a formal grounded theory (...) that could explain democratic social change endeavors across different domains and levels of analysis. This democratic social change grounded theory answers the research question: How do the principles of the American founding documents provide an understanding of the process of American democratic social change? Conditionalists say that the value something has as an end—its final value—may be conditional on its extrinsic features. They support this claim by appealing to examples: Kagan points to Abraham Lincoln’s pen, Rabinowicz and Rønnow-Rasmussen to Lady Diana’s dress, and Korsgaard to a mink coat. They contend that these things may have final value in virtue of their historical or societal roles. These three examples have become familiar: many now merely mention them to establish the conditionalist position. But the (...) widespread faith in such cases is, I believe, unjustified. This is because, surprisingly, the pen, the dress, and the coat cannot have final value. I argue that the problem is internal: these cases are ruled out by every conditionalist account of final value. Further, the problem with these well-known cases applies to most other supposed examples of extrinsic, final goods. Thus nearly all cases given to support the conditionalist view cannot succeed. I suggest a kind of diagnosis: I claim that these examples are best seen as instances of sentimental value, rather than final value. I close by providing a brief account of sentimental value and explain how it relates to instrumental, intrinsic, and final goodness. (shrink)

OBJETIVO -/- O estudante de Zootecnia e de Veterinária, quando se depara com a produção animal, um dos pilares importantes é a reprodução, uma vez que é a perpetuação da espécie, seja para gerar filhas de uma vaca campeã em produção leiteira e de um touro com rusticidade e com aptidão produtiva de corte, ou mesmo para reposição de um plantel, o mesmo deve estar consciente de que esse ramo é de extrema responsabilidade, já que estará intimamente lidando com a (...) vida e com um investimento que pode gerar lucros em demasia para a propriedade ou, se mal feito o manejo da reprodução, trazer sérios transtornos para a mesma. -/- Nesse trabalho, o estudante revisará os sucessos da puberdade e estacionalidade reprodutiva relacionando-os com os processos endócrinos e os fatores que afetam sua manifestação como os nutricionais, para compreender a maneira ao qual podem ser manipuladas. -/- -/- • _____INTRODUÇÃO -/- A puberdade marca o início da vida reprodutiva do animal, permitindo integrar o indivíduo ao seu ciclo produtivo. A estacionalidade é uma característica de adaptação que algumas espécies desenvolveram para fazer garantir a eficiência da reprodução e a sobrevivência dos filhotes. -/- -/- • _____PUBERDADE -/- A puberdade é atingida quando o animal é capaz de produzir e liberar gametas viáveis e funcionais (férteis). Na fêmea esse fato ocorre na primeira ovulação, que geralmente coincide com a manifestação do comportamento do cio; e nos machos durante a primeira ejaculação com espermatozoides viáveis. -/- Do ponto de vista da produção animal, puberdade prematura ou precoce, é importante para poder permitir a incorporação dos animais ao ciclo produtivo o mais rapidamente possível. No caso de touros holandeses, por exemplo, é desejável que produzam sêmen precocemente para incorporá-los a prova de progênie; nas fêmeas, entretanto, deve-se considerar que nem sempre é conveniente usar o primeiro ciclo ou cio para reprodução. É o caso das marrãs (porcas primíparas), onde é benéfico esperar até o segundo ou terceiro estro para aumentar o tamanho da ninhada. Também pode ser vantajoso esperar que o indivíduo alcance sua maturidade sexual, que ocorre quando a fêmea consegue se reproduzir sem sofrer efeitos adversos. A ovelha nascida na primavera, por exemplo, pode engravidar no outono seguinte e dar à luz no primeiro ano de vida, mas seu crescimento pode ser afetado; o mesmo ocorre com a novilha, em que o acasalamento precoce pode promover distorcia por falta de desenvolvimento pélvico. -/- A puberdade é um processo gradual e está intimamente relacionada à taxa de crescimento e ao metabolismo energético. O recém-nascido usa energia para funções vitais, principalmente termorregulação; esse feito se deve ao fato de os jovens possuírem uma superfície corporal muito elevada em relação ao seu volume. Durante o desenvolvi-mento subsequente dos tecidos também há prioridade no uso de nutrientes, que inicialmente favorecem o desenvolvimento do tecido ósseo e muscular, e uma vez que estes atingem determinado tamanho de acordo com as condições genéticas do indivíduo, inicia-se o desenvolvimento do tecido adiposo, que é indicativa de um reservatório de energia. É importante ressaltar que existe uma interação entre a genética e o meio ambiente, de forma que o potencial genético só será expresso se o meio ambiente for favorável. -/- Para que a ovulação ocorra, é necessário considerar o funcionamento do eixo hipotálamo-hipófise-gonodal. O aumento da frequência pulsátil do GnRH hipotalâmico e em consequência do LH hipofisário provoca a maturação do folículo em nível gonodal, o que aumenta a produção de estrógenos. O aumento dos estrogênios causa, por feedback positivo no hipotálamo, a liberação do pico pré-ovulatório de LH e, consequentemente, a ovulação. Na fase pré-púbere, a frequência dos pulsos de GnRH e LH é muito baixa e insuficiente para provocar a maturação folicular, pois o hipotálamo é inibido e, portanto, não ocorre ovulação. -/- A geração pulsátil de GnRH no momento reprodutivo adequado para desencadear o início da puberdade depende de uma rede neural complexa que, além dos neurônios GnRH, inclui outros neurônios e células da glia; ele também integra vários sinais internos e externos para o corpo. A morfologia dos neurônios GnRH também é única, uma vez que seus dendritos também podem funcionar como axônios, dando-lhes uma função distinta. A geração de pulsos também indica a necessidade de sincronização entre subpopulações de neurônios GnRH, que, acima de tudo, parece ser extrínseca a esses neurônios e envolve múltiplos hormônios e neurotransmissores -/- Se dois níveis de conexões aferentes são considerados, estima-se que cada neurônio de GnRH pode ser conectado a cerca de cinco milhões de outros neurônios; milhares de genes, então, podem estar envolvidos no processo da puberdade. A importância funcional e hierárquica de cada um desses genes no controle dos neurônios GnRH, juntamente com outros fatores neuronais e gliais, pode diferir entre as espécies. Existem, no entanto, componentes fundamentais que parecem ser comuns a todos os mamíferos e que se situam nos níveis hierárquicos mais elevados, ajudando a compreender a progressão do processo puberal. Assim, todas as espécies de mamíferos estudadas, por exemplo, têm aglomerados de neurônios kisspeptinérgicos (que secretam kisspeptina), envolvidos na regulação da secreção tônica e secreção cíclica de GnRH, que também se classifica como o elemento mais alto na hierarquia desse complexo neuronal após considerar os neurônios GnRH. -/- Sabe-se que o eixo hipotálamo-hipofisário-gonodal está ativo desde as primeiras fases da vida do indivíduo, mesmo antes do nascimento em certas espécies. A secreção de GnRH, no entanto, é suprimida mais tarde no desenvolvimento e permanece dessa forma até o período pré-púbere, quando será reativada gradualmente. -/- Por várias décadas, a supressão e reinicialização dos pulsos de GnRH foi atribuída a uma hipótese conhecida como teoria gonadostat que afirma que o centro tônico do hipotálamo é inibido devido à sua sensibilidade ao mecanismo de feedback negativo dos esteroides gonodais, é aumentado; portanto, o GnRH e a consequente secreção de gonadotrofinas (FSH e LH) são insuficientes para a ocorrência da maturação folicular e espermatogênese. Essa sensibilidade diminui progressivamente à medida que a puberdade se aproxima. -/- Sabe-se agora que existem fatores não gonodais que agem em paralelo com os esteroides para mediar mudanças no feedback negativo que também são específicos da espécie. -/- Na fêmea, o centro gerador de pulso cíclico também deve ser considerado, o qual é responsável por iniciar a primeira ovulação. O centro cíclico é composto por uma segunda subpopulação de neurônios GnRH que é reativada por meio de uma complexa interação entre vários sistemas neuronais inibitórios (que devem reduzir progressiva-mente sua influência) e outros sistemas excitatórios, que, por sua vez, operam por meio de diferentes neurotransmissores, como o ácido γ-amino-butírico (GABA) e seus receptores, glutamato, óxido nítrico e neuropeptídio Y (NPY). Esses fatores, juntamente com as alterações morfológicas observadas nos neurônios do GnRH à medida que a puberdade se aproxima, e com as interações e sinais aferentes das células gliais, levam a um padrão de progressão linear que culminará na reativação do centro cíclico. Esse processo era conhecido anteriormente como teoria da maturação central e faz parte das mudanças que configuram o processo para chegar à puberdade. A elevação nas concen-trações de estradiol subsequente à reativação gradual do centro gerador de pulso tônico GnRH provavelmente permitirá a maturação final do centro cíclico. -/- A forma como cada organismo estabelece o momento certo para iniciar as mudanças que levam à puberdade é conhecido; a existência de algum mecanismo neurobiológico que constitui um relógio interno pode ser considerada. No entanto, esse mecanismo afetaria principalmente o desenvolvimento neuronal no nível central; também seria difícil compará-lo com a maneira pela qual fatores externos ao indivíduo afetam o início da puberdade. Nessa perspectiva, um sistema que permita receber informações completas sobre o crescimento e desenvolvimento do indivíduo poderia ser mais prático. Os mediadores desse sistema incluem o hormônio do crescimento, IGF-I, leptina e outros substratos metabólicos. A leptina em particular, que sinaliza as reservas de tecido adiposo, é um dos elementos mais importantes e, embora não determine quando começa a puberdade, se atua como fator permissivo para que o processo progrida, uma vez que excede um nível limite. A consideração do estágio de desenvolvimento do animal para o início da puberdade era anteriormente conhecida como o peso corporal crítico ou teoria do lipostato. É importante considerar que as três teorias mencionadas não são exclusivas. -/- O mecanismo da puberdade nos machos é semelhante ao já descrito; entretanto, deve-se lembrar que no macho o centro cíclico não está ativo. À medida que a puberdade se aproxima, o crescimento testicular é desencadeado e, em ruminantes e suínos, o pênis que estava preso à mucosa prepucial é gradualmente liberado. -/- -/- • _____FATORES QUE INFLUENCIAM A PUBERDADE -/- Os animais podem manifestar a puberdade de três formas diferentes. Pode ser tardia e o animal demorar para estar apto a reprodução; precoce e o animal entrar na vida reprodutiva antes do esperado ou pode ser normal e o animal estar com boa conformação e idade. Para tanto, alguns fatores podem interferir à manifestação da puberdade pelos animais como a genética, idade e peso, nutrição, fotoperíodo e o próprio manejo adotado. -/- -/- Genética -/- O genótipo afeta a idade da puberdade, pois algumas raças são anteriores a outras. Nos bovinos, as raças europeias atingem a puberdade antes dos zebuínos, isto é, uma novilha ou novilho da raça holandesa atinge a puberdade primeiro que os animais da mesma idade e do mesmo peso da raça nelore, por exemplo. -/- Da mesma forma, as porcas da raça chinesa Meishan atingem a puberdade por volta dos 115 dias de idade, metade da idade das raças brancas. As ovelhas de raças de corte, da mesma forma, são mais precoces que os produtores de lã. As raças pequenas, da mesma forma, são geralmente mais precoces, pelo menos em bovinos (jersey x guzerá) e em caninos. Os híbridos, por outro lado, apresentam puberdade mais precoce que os puros, devido ao efeito da heterose. Por este motivo, em certas espécies são utilizadas linhas híbridas. -/- -/- Idade e peso -/- A tabela 1 mostra a idade média de início da puberdade em espécies domésticas. O peso vivo (PV) adulto é mais relevante para a idade na puberdade nos ruminantes, enquanto em suínos é menos decisivo. A superalimentação também não é recomendada, pois pode alterar tanto os sinais que são recebidos pelo hipotálamo quanto sua resposta a eles. -/- Logo, o manejo alimentar adotado deve estar de acordo com as normas estabeleci-das pelos especialistas na área, principalmente no tocante as exigências nutricionais que devem servir de regra na propriedade. Sendo assim, os animais entrarão em puberdade com as taxas de alta qualidade o que afetará positivamente na prole futura e dará retorno lucrativo ao proprietário. -/- -/- Época do ano (Fotoperíodo) -/- Em fêmeas de espécies sazonais, como ovelhas e cabras, existem certos requisitos de fotoperíodo que devem ser atendidos para que a puberdade ocorra. Nessas espécies, um período de exposição a dias longos é necessário, seguido por outro de exposição a dias curtos. Na verdade, os cordeiros e cabritos nascidos fora da estação, mesmo que tenham atingido o peso necessário, terão que esperar até o outono seguinte (a estação reprodutiva) para atingir a puberdade. Os machos, por outro lado, não estão sujeitos a essas limitações nos requisitos fotoperiódicos para apresentar a puberdade. -/- Em novilhas nascidas no outono, por outro lado, a puberdade ocorre antes de um ano de idade, no verão seguinte ou no início do outono, mais cedo do que nas nascidas na primavera, devido à exposição a longos dias durante os primeiros seis meses do ano após seu nascimento aceleram seu crescimento. Em gatos, o aumento do fotoperíodo também acelera o início da puberdade. -/- Em ovelhas e novilhas, a primeira ovulação que ocorre ao entrar na puberdade é silenciosa; ou seja, não é acompanhada de sinais comportamentais de cio como a micção frequente, inchamento da vulva, uma montando a outra e deixando-se montar etc., pois para que esse comportamento se manifeste, o sistema nervoso necessita de uma pré-sensibilização com progesterona que não estará presente até o próximo ciclo, após o desenvolvimento do corpo lúteo vindo desta primeira ovulação. -/- -/- Sociossexual -/- A interação de indivíduos da mesma espécie ou a presença ou ausência de sinais de bioestimulação, como feromônios, pode afetar o período de puberdade. A puberdade, por exemplo, é atrasada em porcas criadas individualmente em comparação com porcas criadas em grupo. Além disso, na porca, ovelha e cabra, a exposição ao macho estimula as fêmeas e a puberdade aparece mais precocemente. -/- -/- Manejo -/- Certas práticas de manejo podem acelerar a puberdade, especialmente no período pré-púbere. Em porcas próximas à puberdade, por exemplo, o estresse causado por procedimentos, como o transporte de um local para outro ou a exposição ao macho, faz com que apareça o estro em torno de sete dias após a realização do manejo mencionado. -/- -/- • _____ESTACIONALIDADE REPRODUTIVA -/- A estacionalidade ou sazonalidade reprodutiva é uma estratégia evolutiva que se desenvolveu em algumas espécies; tende a tornar a reprodução mais eficiente. Nos países de latitudes distantes do equador, o objetivo é que as crias nasçam na primavera, época do ano mais favorável, graças à abundância de alimentos e às amenas condições climáticas. No caso da ovelha, cuja gestação dura cinco meses, para que os partos ocorram na primavera, ela deve engravidar no outono (figura 1), quando os dias são curtos; enquanto a égua, tendo uma gestação de aproximadamente 11 meses, deve conceber na primavera, quando os dias são longos; assim, o parto ocorrerá na primavera do ano seguinte (figura 2). -/- -/- Figura 1: Esquema ilustrativo da estacionalidade reprodutiva na espécie ovina. Ovinos e caprinos se reproduzem na época do ano em que os dias são curtos e os equinos quando são longos. O grau de sazonalidade depende da origem da raça. As raças nativas de países localizados em latitudes elevadas (> 50°,ovelhas: soay, blackface, suffolk; cabras: saanen, alpino francês, toggenburg; equinos: puro-sangue, hanoveriano) terão uma estacionalidade mais acentuada do que as latitudes menores ou mediterrâneas (ovelhas: merino; cabras: murciana granadina; equinos: quarto de milha). Também existem raças de latitudes próximas ao Equador cuja estacionalidade é baixa ou nula (ovelhas: raças de pelo, crioulas; cabras: raças africanas e asiáticas) (tabela 2). -/- Para a maioria das raças de ovinos e caprinos, a estação reprodutiva começa no final do verão e início do outono; caracteriza-se pela apresentação de ciclos estrais sucessivos, e termina no final do inverno, quando se inicia o anestro, que se caracteriza pela ausência de ovulação. Consequentemente, a pulsatilidade do LH também diminui, que agora é incapaz de induzir a maturação folicular, o aumento dos estrogênios, o pico pré-ovulatório de LH e, portanto, a ovulação. -/- Isso ocorre porque durante o anestro a sensibilidade do hipotálamo ao mecanismo de feedback negativo dos estrogênios e de outros fatores de origem não gonodal é aumentada. Ao aproximar-se da estação reprodutiva, a sensibilidade hipotalâmica diminui e o aumento da pulsatilidade do GnRH causa as mudanças que culminam na ovulação. Portanto, o mecanismo endócrino do anestro estacional é semelhante ao do anestro pré-púbere e de alguns outros tipos de anestro. -/- A estacionalidade é um bom exemplo da interação entre o meio ambiente e o sistema neuroendócrino, pois o organismo é capaz de traduzir um sinal externo ambiental, como o fotoperíodo, em um sinal hormonal interno, que neste caso é a melatonina. -/- A glândula pineal secreta melatonina durante as horas de escuridão. Os animais sazonais apresentam um ritmo reprodutivo endógeno, que é regulado por janelas de fotossensibilidade, determinadas por mudanças na duração do dia. O sinal luminoso é captado pela retina e conduzido, via nervo, pelo trato retino-hipotalâmico até o núcleo supraquiasmático, que funciona como o relógio biológico do corpo. Daí o sinal viaja para o núcleo para-ventricular, depois para o gânglio cervical e, finalmente, para a glândula pineal, que responde secretando melatonina (figura 3). -/- Nas ovelhas, a estação reprodutiva começa quando a duração do dia diminui e, naturalmente, a noite aumenta; na égua, ocorre quando os dias se alongam. -/- A primavera não é necessariamente a melhor época do ano em todas as regiões do globo. No USA president in history has received as much opposition as Donald Trump has from all three components of the Establishment, namely the financial establishment, the political establishment and the corporate media establishment. The election of Donald Trump to the office of presidency is marked with dozens of historical first events that are anything but lackluster, yet a bleak picture of Fascism has been painted to describe Trump. This is an extraordinary piece of disinformation, as no modern president has been (...) more consistent in plainly saying what he will do regarding US military and geopolitical goals, both outside and in office. This, even though his stated position is clearly opposite to the wishes of the dominant cabal, supported by both parties, and to US foreign policy since WWII. USA history is not very long, but Trump presidency and his inaugural speech marked a historic starting point for this 'democracy'. Every sentence of Donald J. Trump's inaugural speech was a departure from diplomacy. Knowing what diplomacy actually means, it's a great step toward transparency. It is the best thing that happened in US political history. It is no surprise the Media established completely flipped, the political establishment gasped, and the financial establishment started to conspire a different strategy (George Soros declaring he wants Trump presidency to fail). In the mean time, the typically apolitical science and technology establishment declared Trump completely unfit for the office that he has just been elected to. Trump’s inaugural speech that contained phrases like, "It's time to remember that old wisdom our soldiers will never forget, that whether we are black or brown or white, we all bleed the same red blood of patriots", was in sharp contrast to how Abraham Lincoln viewed America, when he said, "I, as much as any other man, stand in favor of having the superior position assigned to the white race… I have no purpose to introduce political and social equality between the white and the black races." Trump’s embrace of humanity and righteousness was reminiscent of Prophet Muhammad’s last sermon at the pilgrimage, where he said over 1400 years, "An Arab is no better than a non-Arab, and a non-Arab is no better than an Arab; a red man is no better than a black man and a black man is no better than a red man – except if it is in terms of piety." Yet, Trump took oath of office swearing on the bible used by Abraham Lincoln. In this two-part paper, the key research question answered is what Trump presidency stands for. In answering this question, the first part deconstructs some of the dominant theories of Fascism. Then, a delinearized history is constructed in order to understand how democracy, as applied in USA, has an inevitable outcome of achieving the same goals as a Fascist regime. The concept of religious extremism, including “Islamic terrorism” or “radical Islam” is also discussed with relevance to ‘war on terror’. The history of US presidency then shows that the office of presidency is used as a tool to advance a Fascist agenda, albeit being packaged as USA exceptionalism. The ground is set for part 2 that analyses the rise of Trump and the demise of DNC integrity, followed by deconstruction of various allegations against Trump. (shrink)

Presentists argue that only present entities exist absolutely and unrestrictedly. Presentism, which itself is a temporal analog of the modal doctrine of actualism, is an ontological idea about time and existence against theories such as eternalism, possibilism, and growing block theory. Thus, presentists deny the existence of atemporal or timeless entities and describe presentism as a version of the (A-theory), which makes a difference between present, past, and future. Also, presentists are not able to ontologically, justify the existence of some (...) entities such as Socrates and the year 3000 in the past and the future and the relations involving non-present objects like ‘Abraham Lincoln was taller than Napoleon Bonaparte’. However, presentism is altered via the addition of an abstract four-dimensional manifold of ersatz time, which is a type of (B-theory) series, to identify all ontological entities and justify the dynamic world. This inquiry is an attempt to put a completely different perspective on presentism and, the result obtained that despite the new conceptualization of time, there is an inconsistency between time and being in presentism. Therefore, presentists have failed to determine the ontological identification of cross-temporal relations, reference and propositions, and truth-makers. Also, whatever the final outcome of the debate between presentism and other views is significantly eternalism, according to ersatz presentism, it is hard to make sense of the idea that things change from one moment to the next. While aestheticians have devoted substantial attention to the possibility of acquiring knowledge from fiction, little of this attention has been directed at the acquisition of factual information. The neglect traces, I believe, to the assumption that the task of aesthetics is to explain the special cognitive value of fiction. While the value of many works of nonfiction may be measured, in part, by their ability to transmit information, most works of fiction do not have this aim, and so many conclude (...) that the transmission of information is irrelevant to their value. I am skeptical of these claims. I doubt that there is any value, cognitive or otherwise, special to all and only works of fiction. Thus I see no reason to neglect the capacity to convey factual information—specifically, propositional knowledge about real individuals and events—when assessing the value of particular works. In this paper I consider the value of learning about history from a particular work of fiction, Gore Vidal’s Lincoln: A Novel. Drawing on recent work in cognitive psychology, I argue that narrative devices used by Vidal can enhance our ability to learn and retain factual information, despite also increasing the possibility that we will form false beliefs, and that acquiring propositional knowledge from fiction, far from being a process we can take for granted, constitutes a difficult achievement. The year 2009 has been a year of numerous commemorations of both scientific and non-scientific achievements that contributed to the advancement of human kind. Protestants celebrated the 500th anniversary of the birth of Calvin; literary critics celebrated the 200th anniversary of the poet Edgar Allan Poe; and the musical genius Felix Mendelssohn-Bartholdy was also born 200 years ago. 2009 further marked the bicentennial of the birth of Louis Braille, the inventor of Braille; and Abraham Lincoln, the 16th president of (...) the United States, who founded the National Academy of Sciences. Pierre Curie, famous for his work on radioactivity that he conducted together with his wife Marie Curie, was born 150 ago; as was John Dewey, a philosopher and psychologist who is recognized as one of the founding fathers of both pragmatism as well as functional psychology. UNESCO and the International Astronomical Union dubbed 2009 the International Year of Astronomy. By doing so, astronomers celebrated the 400th anniversary of Galileo Galilei’s telescopic observations as well as the publication of Johannes Kepler’s Astronomia nova wherein he formulated the first two laws of planetary motion. 2009 also marked the last of a 3-year-long celebration of Planet Earth, another UNESCO-governed initiative. However, for evolutionary biologists and philosophers of science, 2009 will be largely remembered for its worldwide commemorations of the 200th anniversary of the birth of Charles Darwin, and the 150th anniversary of the publication of his magnum opus On the origin of species by means of natural selection. Footnote1 In order to pay tribute to Darwin’s major contribution to the advancement of evolutionary science, the International Union of Biological Sciences and the International Union of History and Philosophy of Science have called the year 2009 the Darwin Year. Given that so many scientific discoveries were commemorated, COPUS, the Coalition on the Public Understanding on Science, called out 2009 as the Year of Science, in the hope to pay equal tribute to both the field of biology as well as astronomy. 2009 was indeed a year of biology. Somewhat overshadowed by the big Darwin celebrations, smaller-scaled events were held to commemorate the 200th anniversary of the publication of Lamarck’s Philosophie Zoologique; and the 150th anniversary of the death of Alexander von Humboldt, the father of biogeography. In 1910, Constantin Mereschkowsky wrote his article on symbiogenesis entitled ‘The Theory of Two Plasmas as the Basis of Symbiogenesis, a New Study for the Origins of Organisms’. The article was published in the German Biologisches Zentralblatt, the journal that would later evolve into the current Theory in Biosciences. Somewhat forgotten, but equally important for the field of symbiogenesis, was the 200th anniversary of the birth of Pierre-Joseph Van Beneden, a Belgian paleontologist and zoologist famous for distinguishing parasitism from commensalism. Finally, Henry Bergson, known for inventing the currently rejected notion of élan vital, was born 150 years ago. In order to memorialize the important role these biologists played in the advancement of our understanding of the evolutionary process, a 2-day international conference was organized entitled: Evolution today and tomorrow, Darwin evaluated by contemporary evolutionary and philosophical theories. The conference was organized by The Centre for Philosophy of Science of the University of Lisbon (Portugal), in collaboration with the Centre for Environmental Biology of the same university, and the Lisbon Centre for Applied Psychology. The articles presented here are a spin-off of this conference. The current volumes contain the peer-reviewed articles of a selection of the plenary and invited speakers, as well as those of scholars who were additionally invited to contribute to the volumes. This paper examines the problem of poor orientation of most Nigerian citizens, especially the rural dwellers, occasioned by the dearth and failure of modern media in rural Nigeria; a phenomenon that has led to a major setback in participatory governance and national development in a country. The objective of the paper is to investigate the causes of modern media failure in national orientation and development in Nigeria and to examine the need to adopt traditional African media as a viable alternative (...) in Nigeria’s national orientation and development programme especially at the grassroots. This paper assumes that African traditional communication media as effective tools have been ignored in the national orientation programmes despite their relevance to national development. The paper adopts an analytical research method to examine secondary sources of data on the constraints of modern media in rural Nigeria and the viability of African traditional media in Nigeria’s national orientation and development’s efforts. Findings reveal that most Nigerian citizens, especially rural dwellers, do not understand national orientation messages because they are broadcast in English rather than their respective languages and the broadcasts are made on modern media channels that exist in urban areas. Findings also reveal that that government’s lack of political will, high cost of setting up community media, absence of professional journalists and selfish interests of Nigerians are factors responsible for the non-existence of modern media channels in rural Nigeria. Findings also reveal that African traditional media is very compatible to the communication needs of rural Nigerians. The paper concludes that the National Orientation Agency (NOA) in Nigeria has had reduced effectiveness and therefore, recommends the use of African traditional communication media in addition to the use of modern media such as television, radio and print materials to accord Nigerians the necessary orientation that will commit the citizens towards the task of national development. Mortalidade EMBRIONÁRIA -/- A mortalidade embrionária (ME) é uma desordem reprodutiva responsável por cerca de 15% das falhas da gestação. Em si, a ME pode ser dividida em dois grandes grupos, a ME precoce, ou seja, aquela que ocorre nos primeiros dias da gestação, por problemas específicos de reconhecimento materno-fetal, (...) que não geram alteração significativa do ciclo estral, já que, não se afeta o corpo lúteo (BONDURANT, 2004). A segunda forma da ME, denominada ME tardia, altera o ciclo estral e se apresenta por rejeição da implantação em suas primeiras fases, usualmente se apresenta entre 25 e 40 dias pós-serviço. De acordo com GEARY (2005) existem múltiplas causas associadas à ME, entre essas causas listam-se os problemas de rejeição imunológica, a ausência de fatores de reconhecimento materno-fetal, problemas infecciosos, estresse e deficiências nutricionais, sobre essa última pode-se citar: 5.1 Deficiência de betacarotenos Os betacarotenos são precursores da vitamina A (provitamina A). São pigmentos vegetais de cor amarela ou laranja que, uma vez ingeridos, se transformam no fígado e no intestino delgado em vitamina A. São antioxidantes que ajudam o organismo a eliminar os radicais livres tóxicos que causam a oxidação dos tecidos (reação química de peroxidação que produz lesão nos tecidos já que os peróxidos são compostos tóxicos e cancerígenos) em células, proteínas e no material genético como DNA. Os radicais livres são normalmente formados como subprodutos do metabolismo oxidativo energético do organismo. Os betacarotenos atuam atrapalhando estes radicais livres e moléculas de oxigênio livre, e daí parte seu efeito protetor o qual centra-se na defesa da parede epitelial, pois sendo precursores da vitamina A, induzindo a sua síntese protegem a parede epitelial do enfraquecimento das suas membranas, evitando assim a entrada fácil de microrganismos patogênicos que possam, especificamente no caso de uma fêmea gestante, produzir infecções que ataquem o embrião provocando a sua morte, uma vez que aumenta-se a resistência imunológica. Além disso, intervêm também na diferenciação das células estaminais do embrião, evitando que ocorram malformações que possam originar mortalidade embrionária, e também evitando a assimetria do organismo que se está formando. A vitamina A, ajuda na conservação dos epitélios para um funcionamento normal. Uma deficiência desta, produz uma alteração dos epitélios que revestem o aparelho genital, podendo ocasionar diminuição da barreira protetora que formam as membranas, os microrganismos patogênicos podem entrar facilmente, desencadeando a morte do embrião. A vitamina A, atua no momento em que as células tronco do embrião entram em uma área deste, chamada "Nódulo de Hensen", começam a formar três camadas embrionárias de células que dão passagem ao sistema nervoso, digestivo, circulatório e outros sistemas do corpo. Células específicas localizadas nesta zona do embrião utilizam seus cílios (que segregam vitamina A) para criar correntes no fluido que as rodeia e dirigir as células estaminais para o seu destino final. Estas células-tronco, antes de chegar ao nódulo do embrião "não estão orientadas espacialmente e tampouco estão diferenciadas em tecidos concretos" embora depois de cruzar esta porta, recebem ordens genéticas necessárias para se colocarem no interior do organismo em desenvolvimento e conhecerem qual vai ser a sua diferenciação específica. Então a ação desta vitamina faz com que algumas destas células ignorem as instruções de diferenciação esquerda e direita, prosseguindo simetricamente. Segundo isto, em uma deficiência de vitamina A, o aspecto exterior do corpo também acabaria por ser assimétrico perdendo potencial de aceitação na implantação, levando os mecanismos naturais de vigilância de estabilidade celular a sua destruição e, portanto, gerando a ME (TORRES et al., 2002). Os níveis de vitamina A, bem como de outras vitaminas, na alimentação de bovinos de corte ou leite já foram discutidos. Cada animal tem sua particularidade de ingestão diária de vitaminas conforme a idade, sexo, categoria, etc. e que esses requerimentos são, muitas vezes, variáveis conforme a disponibilidade, isto é, pode-se fazer a injeção direta de fármacos em líquido ricos em vitaminas no animal, ou pode-se optar pelo fornecimento nos alimentos concentrados (ração) ou pelos volumosos (gramíneas, forrageiras e leguminosas). Deve-se estar atento para que os níveis não ultrapassem o necessário para que nenhum elemento sobressaia outro e venha a ocasionar afecções além de reprodutivas. 5.2 Relação com a Proteína O excesso de proteína crua na dieta tem sido associada com mortalidade embrionária. Há uma hipótese que sugere que a concentração de LH, e portanto de progesterona, poderiam ser afetadas por elevados níveis de proteína na ração, talvez não de forma direta, porém pela deficiência de energia que os excessos proteicos geram. Existe uma relação estreita entre o excesso de proteína crua e a concentração de progesterona, esta relação é através de uma "exacerbação" do balanço energético negativo em vacas no início da lactação, pela despesa de precursores da glicose e o consumo energético extra que supõe transformar o amônio em ureia (este fato só se relaciona com a proteína degradável no rúmen). Isso ocasionaria um aumento negativo do balanço energético negativo e queda de glicemia, o que seria captado pela hipófise como um sinal negativo para a liberação de LH. Um excesso de proteína tal que reduza os níveis de progesterona e de bTP-1 (proteína trofoblástica), hoje identificada como o Interferão tau (IFN-t), pertencente a uma subclasse dos interferões Ômega, e definidos como fatores de reconhecimento materno-fetal em bovinos, pode causar mortalidade embrionária por volta do 17° dia após a inseminação devido à perda do efeito de ambos os compostos contra a resposta imunitária da mãe (MOREIRA & MORALES, 2001). Os níveis excessivos de proteína na dieta que conduzem a níveis elevados de ureia no sangue reduzem o pH uterino, estimulando assim a produção da prostaglandina F2 alfa (PGF2-α) que, por sua vez, estimula a contratilidade uterina e reduz a viabilidade de implantação do embrião (GALVIS, 2003). Foi também observado que concentrações elevadas de ureia no sangue reduzem a formação de progesterona, alterando a atividade reprodutiva em ambos os casos. A progesterona é uma hormona lipídica que é produzida pelo corpo lúteo sob o estímulo do (IGF-I) e, como foi indicado anteriormente, este fator de crescimento foi igualmente reduzido, uma vez que o potencial genético para a produção de leite aumentou de tal maneira que a redução da concentração de IGF- I pode ser uma das causas da diminuição da concentração da progesterona, por exemplo. Agora, embora considere-se que a hormona do crescimento (HC) regula a síntese de IGF-I no fígado, esta hormona não é eficaz a menos que exista um nível limiar de insulina e esta última também é reduzida em vacas de alta produção no início da lactação (GALVIS, 2003) e em condições de balanço energético negativo, tal como ocorre no pós-parto precoce. As proteínas são essenciais na vida dos animais e do ser humano. Os animais possuem sua particularidade conforme a exigência requerida de proteína e já foi discutido que os melhores métodos para fornecimento racional dessa macromolécula é por meio dos alimentos concentrados ricos em soja que é considerado um alimento proteico por possuir um teor de 60% desta, ou por meio de alimentos volumosos no caso dos capins, silagens, etc. Como já discutido em outros trabalhos, existem tipos diferentes de proteínas com funções também distintas, citamos a proteína bruta (PB) e a proteína metabolizável (PM), ao qual os animais requerem em porcentagens que devem estar presentes no alimento que o criador fornece e que o animal ingere. -/- Apoio -/- Realização -/- •_ _referências bibliográficas -/- BOLAND, M. Neil Gorsuch lauds judges who purport to “apply the law as it is, focusing backward, not forward, and looking to text, structure, and history to decide what a reasonable reader at the time of the events in question would have understood the law to be . . . .” It’s hard to see how such a form of Originalism withstands scrutiny. -/- First, using “reasonable reader” understandings rather than speaker meaning turns language and law on their heads. Audiences effectively become (...) the speakers in ordinary speech (since reader or audience meaning prevails), and audiences (and thus the ruled) effectively become the rulers when interpreting law (since audiences’ meaning prevails). -/- Second, since laws look forward to govern conduct, how can best legal practices keep such a backward focus? -/- Third, words (however understood by others at the time “originally” uttered) may or may not (depending on speaker and not reader meaning) signify concepts whose meanings embrace change over time. For example, the word “planet” used by a speaker before the discovery of Uranus and Neptune may or may not include further planets depending upon what the speaker meant by “planet.” (The same applies to the inclusion or exclusion of Pluto had the speaker used the word “planet” after the discovery of Pluto but before its exclusion by current science.) Unlike the “reasonable” reader of Gorsuch’s Originalism as phrased above, speakers run the gamut from reasonable to unreasonable, from informed to uninformed, and from thoughtful to thoughtless. -/- Fourth, to the extent a judge is principally “constrained” by a text or texts (as he may determine), by dictionaries that he chooses, and by “history” as the judge understands it, isn’t judicial activism encouraged rather than restrained? Talk of a “reasonable” reader masks the fact that there can be multiple “reasonable” conclusions of what a reasonable or unreasonable speaker meant. Is a judge not therefore left to pick definitions and applications of terms that accord with the judge’s understandings of history, understandings that may well be colored by the judge’s politics and judicial philosophy? This applies to principles as well as labels for things. Principles are also subject to multiple frames, and their terms are subject to multiple definitions therefore raising the very same questions just raised above. -/- Finally, such Originalism doesn’t merely fail with legal texts. It also fails when applied to other texts (including sacred texts such as the Ten Commandments) and when used to interpret art (such as “Landscape with the Fall of Icarus” often attributed to Bruegel and which inspired such great ekphrasis as Auden’s “Musée Des Beaux Arts”). Sometimes constitutions fail. The unprecedented election of Donald Trump, a populist insurgent who lacks the prior political experience or military service of all presidents before him, is such a sharp break in American historical experience that it raises questions as to whether something is deeply amiss with the constitutional order. Constitutional failure is not uncommon. A path-breaking global study of national constitutions shows that on average, they last only nineteen years. The U.S. Constitution is an uncommon outlier and, as such, (...) is accounted by many a long-running success story. But could a bell be tolling for American constitutionalism? In this Essay, I assess the meaning of Trump’s shocking rise for the future of our constitutional order. The shock, of course, was not the election of a Republican president. There have been many Republican presidents since Lincoln, each making their own distinctive contribution to the American tradition. Yet, there are good reasons to think this time around is different. The efficacy and, perhaps, stability of our constitutional order are in question, and we should try to understand why. (shrink)

El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular.
